Kollab Terms of Service

Thank you for using Kollab! Please read these Terms of Service carefully before accessing or using Kollab.

BY REGISTERING FOR, USING, OR OTHERWISE ACCESSING ANY OF Kollab’S SERVICES, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, YOU MAY NOT ACCESS OR USE Kollab’S SERVICES.

1. Definitions

  • “Account” represents your legal relationship with Kollab. A “User Account” represents an individual User’s authorization to log in and use the Service.
  • “Agreement” refers to all terms, conditions, notices, and policies, including the Privacy Policy and the Data Protection Addendum.
  • “Applicable Laws” includes all relevant local, state, federal, and international regulations (e.g., GDPR, CCPA).
  • “CCPA” means the California Consumer Privacy Act.
  • “GDPR” means the General Data Protection Regulation (Regulation (EU) 2016/679).
  • “Kollab,” “We,” and “Us” refer to Matterhub LLC, a Delaware corporation operating under the brand name Kollab.
  • “Privacy Policy” refers to the Kollab Privacy Statement, available here.
  • “Service” refers to all applications, software, products, and services provided by Kollab.
  • “User,” “You,” and “Your” refer to individuals, companies, or organizations using Kollab.
  • “User Data” means any data submitted to the Service.
  • “Website” refers to Kollab’s site at https://kollab.ai.

2. Your Account

2.1. Eligibility

The Service is available to:

  • Individuals 18 years or older.
  • Individuals 13 years or older with parental consent.
  • Those of the applicable age of majority in their country.

2.2. Account Security

  • You must create an Account to use the Service.
  • Your information must be accurate and up to date.
  • You must not share your password.
  • You must notify Kollab of any unauthorized account access.

2.3. Authority

If you accept this Agreement on behalf of an organization:

  • Your organization is bound by this Agreement.
  • You warrant that you have the authority to bind your organization.

3. Payments

3.1. Paid Service

  • Certain features are available for free; others require a subscription.

3.2. Payment Method

  • We accept credit cards, debit cards, Stripe, PayPal, and other payment methods.
  • You must keep your payment method up to date.

3.3. Billing & Automatic Renewal

  • Your payment will renew automatically unless canceled.
  • You authorize Kollab to charge your Payment Method.

3.4. Usage-Based Fees

  • Some features are billed based on usage.

3.5. Trials

  • Free trials are available at Kollab’s discretion.
  • Trials automatically renew unless canceled before the trial ends.

3.6. Price Changes

  • We may change subscription prices and will notify you in advance.

3.7. Cancelling Subscription

  • You can cancel your subscription at any time via Billing Settings.
  • You will retain access until the end of your billing cycle.

3.8. No Refunds

  • All payments are non-refundable unless otherwise stated.

4. Acceptable Use

4.1. Compliance with Laws

You must comply with all Applicable Laws when using the Service.

4.2. Content Restrictions

You must not upload or transmit:

  • Unlawful, obscene, pornographic, or defamatory content.
  • Malware, spam, or misleading/fraudulent information.
  • Content that violates third-party rights.

4.3. Conduct Restrictions

You must not:

  • Harass, threaten, or abuse others.
  • Use bots, scrapers, or automated means to access the Service.
  • Introduce viruses or other malicious code.

4.4. Privacy

  • You must not collect Sensitive Personal Information.
  • You must comply with Kollab’s Privacy Policy.

4.5. Bandwidth Usage

  • Excessive bandwidth usage may result in throttling or suspension.

5. User Obligations

5.1. User Data Processing

  • User Data may be stored and processed by Kollab.
  • You are responsible for the accuracy and legality of your User Data.

5.2. No Sensitive Personal Information

  • You must not store, process, or transmit Sensitive Personal Information via the Service.

5.3. Indemnification

  • You agree to indemnify Kollab against any claims related to your use of the Service.

6. Kollab Processing of User Data

6.1. Kollab as a Processor

  • Kollab acts as a Service Provider/Processor under CCPA/GDPR.

6.2. Data Protection

  • Kollab agrees to take reasonable security measures to protect User Data.

7. Copyright Infringement & DMCA Policy

  • If you believe content infringes on your copyright, email: copyright@kollab.ai.

8. Intellectual Property

8.1. Kollab’s Rights

  • Kollab retains all intellectual property rights in its software and services.

8.2. User Data Ownership

  • Users retain ownership of their data.

8.3. User Data Licenses

  • Public User Data is subject to an MIT License unless stated otherwise.

8.4. Feedback

  • Kollab may use Feedback provided by users.

9. Communications

9.1. Electronic Communications

  • You agree to receive communications from Kollab electronically.

9.2. Legal Notices

  • Legal notices must be sent to 30 N Gould St Ste R Sheridan, WY 82801.

9.3. No Phone Support

  • Kollab provides support only through email and electronic messages.

10. Disclaimer of Warranties

  • The Service is provided “as is” and “as available” without warranties.

11. Limitation of Liability

  • Kollab’s liability is limited to the greater of $100 or the amount you paid in the past 3 months.
  • No liability for indirect, consequential, or incidental damages.

12. Indemnification

  • You agree to indemnify Kollab for claims related to your use of the Service.

13. Changes to the Agreement

  • Kollab may update the Terms and notify users of material changes.
  • Continued use of the Service after changes constitutes acceptance.

14. Termination

  • You may terminate your account at any time.
  • Kollab may suspend or terminate your access for violations of this Agreement.

15. Miscellaneous

15.1. Governing Law

  • The Agreement is governed by the laws of Wyoming, USA.

15.2. Assignment

  • You may not assign this Agreement.

15.3. Severability

  • If part of this Agreement is invalid, the rest remains in effect.

15.4. Entire Agreement

  • These Terms constitute the entire agreement between you and Kollab.

16. YouTube Services

  • By using Kollab’s YouTube services, you agree to the YouTube Terms of Service.
